BACKGROUND

This Policy applies to you, the User of this service, and any software licensed to you by Comet Suite. It also applies to your use and our use of any third-party software.

The software, which includes but is not limited to White Label Suite, CloseBot, SynthFlow, or any business, subdomains, domains, or DBA of the same, is the comprehensive suite of tools and applications that you will be using.

1. Definitions and Interpretation

In this Policy, the following terms shall have the following meanings:

"Account" means collectively the personal information, payment information, and credentials used by Users to access any software or system provided by White Label Suite or a third party app;

"Subscriber" means any account created and subscribed to a package under the user;

"Package" means any package or plan created by the user to sell to and create accounts for subscribers for White Label Suite or third party app;

"White Label Suite" means White Label Suite and the parent company of Comet Software Pty Ltd

"Service" means collectively any online facilities, tools, services or information that CometSuite.com makes available through the Web Site either now or in the future;

"System" means any online communications infrastructure that CometSuite.com makes available either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;

"User" / "Users" means any person using the White Label Suite software or third party app is not employed by CometSuite.com and acting in the course of their employment;

and "Website" means the website and all sites owned by CometSuite.com unless expressly excluded by their own individual terms and conditions.

2. Enterprise Plan Options

Monthly Option:

One-Time Setup Fee: As listed on the pricing page of the website.

Credits Included:

Credits provided monthly for the White Label Suite software are listed on the pricing page of the website.

Additional Services:

Includes a $50 credit monthly, which covers up to 10,000 emails, 1,000 SMS messages, and additional services at White Label Suite’s specified rates.

500 voice call minutes. Additional calls will incur additional charges at a rate of 0.25c per minute

Annual Option:

Price: As listed on the pricing page of the website.

No Setup Fee

Credits Included:

Credits provided annually for the White Label Suite software are listed on the pricing page of the website.

Additional Services:

500 voice call minutes. Additional calls will incur additional charges at a rate of 0.25c per minute

The monthly $50 credit will be applied automatically to the subaccount of the Customer Management System provided by White Label Suite, and can be used toward email, SMS, and other services.

Any additional usage beyond the included services will be charged at White Label Suite’s current rates.

3. Credit Policy

Credits for the White Label Suite software are charged at $0.12 per credit for individual purchase. The pricing of credits may be modified by White Label Suite at any time without prior notice.

4. Cancellation Policy

The Enterprise Plan may be canceled at any time with a 30-day written notice. No refund, credit, or account transfer will be granted.

5. No Guarantee of Results

White Label Suite does not guarantee any results by subscribing to the Enterprise Plan. White Label Suite shall only be responsible for ensuring the deliverables are delivered within 30 days of subscribing to the Enterprise Plan.

6. Limitation of Liability

Except as expressly provided in this agreement, neither Party shall be liable to the other Party for any indirect, incidental or consequential damages (including without limitation, damages resulting from loss of use, loss of profits, interruption or loss of business, lost goodwill, lost revenue and lost opportunity) arising out of any of the terms or conditions of this agreement or with respect to its performance hereunder. The foregoing limitation of liability and exclusion of damages applies even if a Party had or should have had knowledge, actual or constructive, of the possibility of such damages. The foregoing limitation of liability and exclusion of damages shall apply whether a claim is based on breach of contract, breach of warranty, tort (including negligence), product liability, strict liability or otherwise, and notwithstanding any failure of essential purpose of any limited remedy herein.

7. Subscriber Support Terms

The first 100 subscribers to the lead generation software are supported by White Label Suite at no additional cost.

Once the customer’s subscriber count exceeds 500, White Label Suite will charge an additional $1,000 per month for every 500 subscribers.

These charges will occur automatically upon exceeding the subscriber threshold, and for every subsequent increment of 500 subscribers.

8. General Terms

All payments must be made in accordance with White Label Suite's billing cycles, and late payments may incur penalties.

Subscription services will automatically renew unless canceled according to the cancellation policy.

Any changes to pricing or credit allocations will be communicated in advance unless otherwise specified under the terms of service.
